Order Nr.2 2019 26th Dec.2018 Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Administrative Punishment Law of the People’s Republic of China, the Administrative Compulsory Law of the People’s Republic of China and other laws and administrative regulations in order to standardize the administrative penalty procedures for market supervision and management, ensure that market supervision and management departments implement administrative penalties according to law and protect the legitimate rights and interests of natural persons, legal persons and other organizations.            Article 2 These Provisions shall apply to administrative penalties imposed by market supervision and management departments.            Article 3 In implementing administrative penalties, the market supervision and management departments shall abide by the principles of fairness and openness, adhere to the combination of penalties and education, and ensure that the facts are clear, the evidence is conclusive, the basis for application is correct, the procedures are legitimate and the penalties are appropriate.            Article 4 The market supervision and management departments shall implement the system of avoidance of administrative penalties.
